Terms of Service

1. Acceptance of Terms

By accessing or using any services, applications, or websites provided by Kaviyes (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Services. We may modify these Terms at any time; your continued use after updates constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under 18 (or the age of legal majority), you must have explicit consent from a parent, legal guardian, or authorized educational institution.

3. Description of Service

Services may be provided as experimental previews or beta versions without guarantees of uptime or stability. Kaviyes reserves the right to modify, suspend, or terminate any Service at any time without prior notice or liability.

4. Intellectual Property

All intellectual property rights in the Services—including algorithms, UI designs, source code, and trademarks—are the exclusive property of Kaviyes. Kaviyes operates independently and is not affiliated with or endorsed by any academic institution.

5. User Content and Output Rights

You retain full ownership of your inputs ("User Inputs") and the resulting exports ("Generated Outputs"). However, creating these outputs does not grant you any ownership of the underlying Kaviyes software or algorithms used to generate them.

6. Acceptable Use Policy

You expressly agree not to engage in the following:

  • Reverse Engineering: Decompiling or attempting to derive the source code.
  • Automated Access: Using scrapers, bots, or unauthorized APIs to extract data.
  • Malicious Use: Transmitting malware or facilitating illegal/destructive activities.
  • Commercial Exploitation: Selling, leasing, or commercially exploiting access to the Services.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." KAVIYES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. We do not guarantee that Generated Outputs are technically accurate, safe for physical implementation, or compliant with any industry standards or academic grading rubrics.

8. Limitation of Liability

IN NO EVENT SHALL KAVIYES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES. This includes, but is not limited to, failing academic grades, project rejections, hardware damage, or financial losses.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of the Philippines. Any legal disputes shall be resolved exclusively in the competent courts located in Davao City, Philippines.

10. Severability

If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
